Director of Public Prosecutions Noordin Haji, on December 6, dared Kiambu Governor Ferdinand Waititu to attempt opening a new office to run the county following the governor’s earlier announcement on Thursday.
Addressing the media on Sonko’s arrest, the no-nonsense DPP argued that the High Court orders issued to Waititu in July and August 2019 still held and nothing would overrule them in whatever case.
“Am warning Governor Waititu and his Samburu County counterpart not to break the terms set by the High Court against them.
“If they dare break the orders, we shall take action and make arrests immediately,” remarked Haji.
The DPP further castigated the Senate for what he termed as overstretching its mandate after it declared on December 5, that governors were free to operate from anywhere apart from the office, referring to Justice Mumbi Ngugi’s orders that county chiefs facing corruption charges were barred from accessing their headquarters.
“The Senate has acted in disregard of the law. The Senate report for Waititu to disregard court orders and open a new office, being aware of the High Court orders and clear pronouncement is worrying,” remarked Haji.
“All bodies must be ready for a ruthless war against any forms of crime to secure the future of our children. We shall not be intimidated,” he added.
On December 5, Governor Waititu announced his resumption of official duties while addressing residents at Limuru Market in Kiambu County, indicating that he would open new offices on December 6.
In a ruling by the Senate on December 5, the house threw out a motion by Narok Senator Ledama ole Kina, which intended to give deputy governors absolute powers to undertake roles of governors in the latter’s continuous absence.
“The County Government of Kiambu is located at Kiambu Town, these provisions notwithstanding, there is no law providing that a governor can only perform the functions or exercise the powers of the office only when in the county government offices,” read Senate Deputy Speaker Kithure Kindiki.
