New Mega Africa Director David Abai is living in fear amid alleged attempts on his life, according to our exclusive investigations.
The transport firm he heads has been entangled in a protracted legal battle with Absa bank.
The dispute arose in November 2022 when New Mega Africa Ltd. sued Absa, accusing the bank’s Nyali branch of disclosing confidential information to unauthorized parties.
The company demanded a hefty compensation of Sh 1.5 billion, leading to an ongoing court case.
Tensions escalated further when witness interference emerged after serving the pleadings on the bank.
One of the bank’s officers allegedly tried to sway a company witness, prompting Abai’s lawyers to engage in discussions with Absa to resolve the matter outside court.
However, the situation took a dark turn for Abai, as he soon noticed unidentified individuals trailing him on unregistered motorcycles.
The threats culminated in Abai reporting the matter to the police, raising concerns about his safety and the ongoing dispute.
Moreover, our investigations have revealed a recent court order in June 2023, which halted Absa’s attempts to auction New Mega Africa’s properties due to unpaid loans.
Insider information leaked to us highlights suspicious meetings held by Absa officials, allegedly discussing plans to eliminate David Abai and avoid the compensation case.
One key suspect, Mr. Wycliff Makori, remains under scrutiny for alleged data breaches, although he has not been suspended.
Makori is also linked to another case involving a client who was swindled of Sh5 million, allegedly orchestrated by regional manager Doufold Odanga and Mwangi Macharia.
These two managers are also facing serious allegations of sexual harassment from female staff members.
The Nyali branch has been under investigation for potential money laundering and client data leaks.
Our evidence suggests that some staff members may engage in inappropriate activities, including relationships with clients, to gain access to sensitive information.
The feud between Absa and New Mega Africa began with the bank’s refusal to approve the company’s loan request promptly, leading to financial difficulties.
Despite numerous appeals for loan restructuring, the bank’s delays severely impacted the company’s operations.
Recently, Justice Josephine Mongare granted an urgent application from New Mega Africa Ltd., issuing a temporary injunction to prevent the bank from auctioning the company’s assets over an outstanding debt of over Sh80 million.
The court order also bars the transfer of a property title in Kitusuru, Nairobi, to a third party during ongoing litigation.
Abai’s apprehension stems from the bank’s mounting pressure and reluctance to resolve the dispute.
The situation has sparked concerns about the bank’s reputation, as it faces allegations of sharing confidential information and possible money laundering, risking losing the trust of its clients.
