Rogue Jubilee Insurance refuses to compensate client

Jubilee Insurance has come under scrutiny for refusing to settle a claim by one of its client over a freak accident that happened two years ago in Eldoret.

The client is now demanding more than Sh2 million as compensation for the losses he has incurred from the detained vehicle which has inconvenienced his businesses and the time he has spent litigating the matter in court.

In a demand letter to the company’s secretary through lawyer Nyongesa Makhanu of Matundura and Wamalwa Advocates, the client states that he has been incurring Sh10,000 daily to hire an alternative vehicle to carry out his business which has caused him to incur a total of Sh2,080,000.

“It is imperative to note that the client’s vehicle is an integral part of his business and it has been detained by the auctioneer for 7 months. The client incurs Sh10,000 daily for alternative double cabin pick up which has totalled Sh2,080,000 which you are liable to compensate,” said the lawyer.

The incident giving rise to the claim happened on July 3rd 2020 along the Eldoret-Webuye Road when the client’s Toyota Hilux double cabin pick-up hit a Toyota Allion belonging to Ebby Tanui.

Since the client’s vehicle was under comprehensive insurance from Jubilee Insurance, they were to cater for the repair costs from the accident.

The insurance company, however, failed to pay for the costs which made Tanui file a suit before the magistrate’s court in Eldoret where the client was ordered to pay Sh255,625 which was to be borne by the insurer.

Due to the court decree, the client’s double cabin pick-up was seized by auctioneers and was set to be auctioned by the auctioneer to recover the money awarded to Tanui but the process was suspended by the court.

Because the client had to continue with his business, he has been forced to hire a vehicle of similar make and capacity for which he pays Sh10,000 daily.

“It is the reason why we warn the Jubilee Insurance to admit liability and make the demanded payments within seven days failure to which we will institute appropriate legal proceedings against the insurance firm,” said the lawyer.

This is not the first time the client is writing to Jubilee Insurance seeking to settle the matter having previously demanded that the insurer settles the claim to enable his vehicle resume business.

But as usual, Jubilee Insurance arrogantly ignored the letters despite being adequately informed in time of the court decision.
