Bosses at the Music Copyright Society of Kenya (MCSK), Kenya Association of Music Producers (KAMP) Performers Rights Society of Kenya (PRISK) are a worried lot as many have amassed wealth and properties through looting.
Kenya Copyright Board (KECOBO) will forward the report of an audit which exposed fraudulent transactions, at the Kenya Collective Management Organisations (CMOs) to the relevant authorities for further investigations and possible prosecutions.
“The Board noted that the responses received from the three CMOs were not sufficient to change the findings of the earlier Draft Forensic Report. Amongst the resolutions reached by the KECOBO Board of Directors include the decision to submit the final audit reports to law enforcement agencies to investigate suspected fraudulent transactions in the CMOs. To facilitate quick investigadons, the Board has directed that the CMO staff and Board members mentioned in connection with possible loss of members’ funds step aside as required under section 46F of the Copyright Act,” the two-paged statement by KECOBO said in par.
The forensic audit conducted by a Ronalds LLP, released two weeks ago, exposed fraud in the organisations.
- diversion of royalties;
- Poor Corporate Governance and separation of roles;
- non-existence of critical policy documents or breach of existent policies in human resource, finance, procurement, operations and ICT;
- non-remission of statutory deduction and non-compliance with statutory requirements;
- negligence in asset management, debt recovery and irregular payments;
- suspected fraudulent transactions;
- significant structural and administrative gaps in management;
- Ghost or duplicate members; and
- poor record keeping in general
The matter is simple and has revealed the mismanagement at the CMOs for which the bosses in the thre organisation ought to face the law.
