On Friday, 28th June 2019, the High Court ruled that the Ruaraka land where two schools, Drive Inn Primary & Ruaraka High School sit is public.
This is the same land where then Education CS Fred Matiang’i and the windy-looking PS Belio Kipsang purchased from conman Francis Mburu of Afrison Exports and Imports Limited for over Kshs. 1.5 billion.
In short the government bought land that it already owns and indeed Matiang’i and his team shouldn’t have paid for this.
But you know how Kenyan State officers roll. There are kickbacks that might have been involved.
How much did Matiang’i and former National Land Commission (NLC) Chairman Muhammad Swazuri and his team pocket so as to lie to systems that this is private land they were buying?
It is said that NLC misled Matiang’i.
NLC, whose chairman at the time was Muhammad Swazuri, had claimed it searched through the ministry’s records and found that it belonged to Mburu.
What will DPP do?
The DPP through their Twitter page update on Saturday wrote the following:.
Court declares that Ruaraka land where Drive Inn Primary & Ruaraka High School sit is public.
Court agreed with Prosecution that Sh1.5B National Land Commission paid to Afrison Export Import Ltd to reclaim the land was fraudulent.
A three-Judge Bench-Justices; Benard Eboso, Elijah Obaga & Kossy Bor said NLC shouldn’t have paid to reclaim land already belonging to government.
DPP will review the case file from EACC & give further directions on prosecution of concerned individuals & recovery of Kshs. 1.5 billion public money.
