UNDER SIEGE: US-based firm wants Simon Gicharu arrested and jailed for Intellectual Property-Theft.
Dr. Simon N. Gicharu, the owner of Mount Kenya University, is being accused of fraud and intellectual property-theft by a US-based company.
While in Kenya, the theft of ideas is the order of the day, other countries take the crime very seriously, and intellectual property has become a core revenue stream for the taxman.
We believe that this case has merit and it will be extremely detrimental for Mr. Gicharu’s MKU to be blacklisted by law-enforcement plus other international bodies concerned with University education.

The deposition of Dr. Simon N. Gicharu (“Dr. Gicharu”) and Mr. Johnson Adera, representative of Mount Kenya University (“MKU”) was obtained in Atlanta, GA on August 31, 2016. Dr. Gicharu and MKU are sued for fraud, breach of contract, copyright and trademark violations, etc., by international Film Maker Yves Tchouta and his production company, XL Squad LLC (“Plaintiffs’).
Yves Tchouta and XL Squad are represented by the Nsahlai Law Firm, particularly attorney Emmanuel Nsahlai, and by Sara Eslami.

In an effort to conceal the truth of his scheme to defraud and use Mr. Tchouta’s intellectual properties and relationships for their own personal gain, the attorneys for Dr. Gicharu and MKU requested that his videotaped deposition transcript be sealed.
Attorney Nsahlai deposed Dr. Gicharu and Mr. Adera.
Plaintiffs’ intend to file criminal complaints against both Dr. Gicharu and MKU for various white collar and fraud crimes, and press charges for prosecution. Plaintiff’s also intend to report MKU to the Inter-University-Council, Association of Common Wealth Universities, IUCEA, ACU, UC-USA, NKU-USA, and all MKU relevant accreditation bodies for the fraud and fraudulent practices alleged in its complaint, including contract breach, violation of intellectual property rights, for investigation and appropriate disciplinary measures.
Plaintiff’s estimated damages are in the millions of dollars USD.
