Yesterday, the Labour Court rejected the tribal appointment of Nairobi Metropolitan Transport Authority (Namata) board members.
Justice Nzioki Wa Makau found it was unconstitutional for the government to appoint Mary Waithigieni Chege, Zachariah Karenge Mungai and Ronald Ndirangu Ndegwa, three people who are from the same ethnic group.
Judge Makau, while ruling on a case filed by the Law Society of Kenya (LSK), found the appointments of the three board members to be unlawful and unconstitutional for failure to represent the diverse Kenyan ethnicity.
However, in Simon Chelugui’s Ministry of Labour, that is the norm.

Good evening Mr. Nyakundi,
I trust you are well. I have an issue that I would like unearthed at the Ministry of Labour. In the month of July, Public Service Commission appointed candidates to various positions at the Ministry of Labour (State Department of Labour).
They were directed to report to PS state department of labour. When they went for letters, they were not given letters to date without any explanation and no communication from the ministry. It is said that the CS Simon Chelugui had a separate list of people he wanted appointed to the ministry but PSC did not do as he wanted.
Now when the listed was taken to the ministry, he withheld it and up to now nobody knows what he is thinking with the list. When the candidates contact PSC, they are told that their work was to recruit and appoint, so they follow with the ministry. When they go to the ministry, they are not given any information regarding the issue.
To make matters worse, it is past the reporting date by about 2 months. Some rumours going round is that the government is broke and cannot employ the appointed candidates.
This leaves us with the question, why did the PSC recruit and appoint the 240 people knowing the government is broke and cannot absorb them? I have attached a list of appointed candidates and the dates they were supposed to join.
I am calling for your assistance in bringing this to the public domain if this can make them release the letters to the appointees.
