Dear Urban Tenancy (ULTAK),
I am one of the aggrieved tenants of Tawan plaza on kolobot road managed by the agent NyumbaLink (www.nyumbalink.com) whose office telephone numbers are 0713 40404/0717717717/0737717717
I viewed the house in March 2018 and was taken to see the available houses by one of the house owners Brian Maina 0711660*** and James Kihara 0714450*** of Nyumbalink.
I was then informed by both as follows:
1) rent + service charge is Kshs 50,000
2) 2 deposits of kshs 90,000, lease fee of Shs 5,000 and water deposit of Shs 2,500
3) I was adviced that I can pay the second deposit in instalments and that all i required to occupy the house was 1 deposit, rent, lease and water deposit.
4) I thereafter paid a deposit total of Kshs 57,500 in March and started tenancy in June 1/2018
Please note that to date there has been no lease agreement and there has been a constant need for repairs since we occupied the unit.
On August 15th 2018, Nyumbalink General Manager Mr Bakari visited my premises without prior consent nor notification and proceeded to disconnect the water supply.
On enquiry, I was informed that it was due to the July bill of Kshs 1,820 and a previous balance of Kshs 520 that was billed in April before I became a tenant.
I went ahead to settle the bill for July but I declined to settle the Shs 520 that had been accrued by the previous tenant.
He then insinuated that I also needed to settle the second deposit of Kshs 40,000
I informed him that as discussed with Ruth in accounts before he joined Nyumbalink, I was to clear the same in 2 parts in August & September.
I further stated that they are already in possession of 1 house deposit & water deposit of Shs 2,500 and the agreement at the time of viewing was to settle the deposit in 2 parts.
This is despite the fact that there is no lease agreement nor any agreement that shows all this which further makes the disconnection a breach of contract.
This is now the 3rd day without water and without getting hold of Mr Bakari as the office admins Pauline & Ruth advice that he is out of the office as they seem very keen to ensure they terrorise and harass the tenants.
Other tenants have had their electricity disconnected – despite being a prepaid facility that belongs to KPLC.
I am very aggrieved especially being a single mother of 2 small children who have been very affected. I believe that I am further discriminated due to my gender.
